I think you have to weigh what might be going on in the moment, but I would generally consider pepper spray, and especially a taser, to be a threat if I were incapacitated by it.

Pepper spray, depending on the type, can usually be fought through, although your abilities are somewhat diminished, the taser not so much.

I think the boy who shot that guy is likely going to be in for some trouble, unless there was something else going on along with it that we arent seeing, that elevates the threat.
