The prosecution can happen because his own fellow senators voted to strip him of the immunity he had for actions undertaken while acting as minister in a democratically elected parliament.

Bottom line: get elected democratically, do something legal (as an action of parliament) that the left finds objectionable, find yourself sued by a left government run by Marx cultists later in your life...
