The fact he went into solitary confinement, banged up for 23.5 hours a day, out for only exercise and phone calls when other prisoners were locked up undoubted saved him from brutal attacks from Muslim prisoners that very well would have killed him if they got half a chance. Despite this the authorities managed to leave his cell unlocked on no less than 3 occasions, inviting opportunity. The court was well aware that he would be killed if the Muslim prison population got a chance. Tommy has been issued with no less than six Osman orders, notices from the U.K. police only issued when there is a concrete threat of someone being murdered. Police have found a car load of Pakistani Muslims, with numerous weapons, including swords, firearms and explosives on route to Tommy's home intent on killing him and his family. They are now serving thirty years each. Huge percentages of prison populations are Muslim. Judge Marsden acknowledged this risk to Tommy when jailing him, saying he had no sympathy as Tommy also knew of the risk and therefore should have avoided breaking the law to ensure he remained out of prison. Today's ruling shows he shouldn't have been sent to jail.
